Millarco International & Cozze Pizza (hereinafter “Cozze”) is subject to the Data Protection Act and the General Data Protection Regulation (“Regulation”), which means that we are obligated to inform about the personal data that Cozze processes concerning natural persons and their rights in this regard.

If we have registered personal data about individuals, there may be several reasons for this. In most cases, it is because the person themselves or the company they represent is a customer or partner of ours. However, it can also be because personal data has been provided to us for other reasons related to a construction project in which we are involved.

1: DATA CONTROLLER

2: PERSONAL DATA AND PURPOSE

In connection with Cozze’ participation in construction projects or other collaborations with Cozze, we need to process and store certain data about customers and partners to some extent. This typically includes contact information (name, address, email address, and telephone number).

All personal data is processed in accordance with data protection laws and the Regulation, and we only process personal data if we have a lawful basis to do so.

Cozze legal basis for processing arises from both legitimate interests, pursuant to Article 6(1)(f) of the Regulation, which Cozze has in processing and storing data, as well as the necessity of such processing to carry out the construction project and thus protect our own, the customer’s, the partner’s, or the individual’s interests, pursuant to Article 6(1)(b) and/or (c) of the Regulation.

3: RECIPIENTS AND PROCESSORS OF PERSONAL DATA

Personal data is processed solely by Cozze, unless other use is necessitated by the nature of the inquiry or the task.

It may be necessary to disclose personal data to others. This will only be done to the extent necessary, following the principle of data minimization. Disclosure may occur, for example, to authorities in connection with regulatory processes, VBA/courts, and the parties involved in a case, including other lawyers, in the event of potential arbitration or litigation, or similar.

Furthermore, your personal data may be disclosed to an insurance company if Cozze needs to seek insurance coverage during a construction project.

Personal data may also be disclosed to our partners and data processors if such disclosure is beneficial or necessary for our processing of a construction project.

4: ACCESS TO INSIGHT, RECTIFICATION, ERASURE, RESTRICTION, AND OBJECTION

You have the opportunity to gain insight into what personal data Cozze has recorded about you. If you wish, Cozze will provide an electronic copy of the collected data.

You can object at any time to the processing of data about you.

Furthermore, you have the right to demand that your registered personal data be corrected or deleted or that the processing thereof be restricted.

If objections to Cozze processing of personal data are raised during the handling of a construction project, or requests for deletion or restriction of data necessary for the handling of the construction project, as described in paragraph 2, Cozze may no longer be able to proceed with the construction project. This may have implications for the relevant agreement, and may result in the contracting party materially breaching the agreement, triggering a halt to the construction project, or leading to other construction law consequences.

Under the Regulation, there may be specific situations in which Cozze is not obligated to comply with the above rights.

5: DATA PORTABILITY

In certain cases, you have the right to receive or have your personal data transferred to another data controller. If you wish to exercise this right, please contact us as mentioned above, after which it will be assessed whether the conditions for this are met.

6: DURATION OF STORAGE

Personal data is stored securely for 10 years from the completion of the construction project, unless there are legitimate reasons to extend this period. Storage is done for the purpose of reviews at 1 and 5 years and to address any subsequent complaints and/or disputes. Contact information is kept as long as necessary for us to be able to communicate with each other.

If our processing of personal data is based on consent provided, the individual is entitled to withdraw this consent at any time. If the individual withdraws their consent, we no longer have the right to process data about that individual unless another legal basis exists. In that case, we will delete the individual’s data. This may mean that we can no longer process certain parts of a construction project, as described above in section 4.

7: COMPLAINTS

You have the option to complain about Cozze processing of your personal data. Complaints can be filed with the Danish Data Protection Agency, Borgergade 28, 5, 1300 Copenhagen K, dt@datatilsynet.dk. You can learn more about this on www.datatilsynet.dk.
